Elon Musk has unexpectedly amended his lawsuit against OpenAI, the company behind the popular AI chatbot ChatGPT, stating that any damages awarded should go to the OpenAI Foundation's charitable arm rather than himself.

In a filing made public on Monday, Musk's legal team asked the court to remove OpenAI CEO Sam Altman from the nonprofit's board and for Altman and President Greg Brockman to turn over any equity or financial benefits to the charity, according to a report by the Wall Street Journal.

The move marks a significant escalation in the ongoing dispute between Musk and OpenAI, which was founded in 2015 with Musk as a co-chair. He departed the company in 2019, alleging it had strayed from its original mission to benefit humanity and sought to convert into a for-profit entity.

Musk's lawsuit, which is set to go to trial later this month in Oakland, California, seeks more than $150 billion in damages from OpenAI and Microsoft, its partner and investor. Musk claims OpenAI defrauded him as a donor by seeking to profit from the technology he helped develop.
